We are now recruiting a US patent attorney to our international IP
team. We are looking for someone who can provide strategic insights
and advice in relation to patents and other IP, harvest new
inventions, prosecute patents, and provide proactive support to
both business leaders and engineers. You will help product teams to
design products which avoid competitor patents. You will support a
variety of medical product areas and many global teams. You will
report to the Head of IP & Digital Law. Our international IP team
is currently split between Sweden and the US.
The role requires occasional international travel. Travel is
anticipated to average 10% annually, but may vary depending on
project needs.
Local and regional candidates available to work at Getinge's Wayne,
New Jersey, USA facilities at least two days per month are
preferred. More distant candidates will also be considered. Hybrid
and remote working arrangements are available.
Key Duties And Responsibilities
Provide practical patent and IP support to Getinge's business and
product teams in Europe, the USA, and beyond. Provide expert
support to the current patent heads for Getinge's Acute Care
Therapy and Surgical Workflows divisions.
Support product development, including identifying patent freedom
to operate (FTO) needs, trade secrets, and patent filing
opportunities.
Review and evaluate invention disclosures, and conduct internal IP
mining and harvesting.
Guide and conduct patent searches, drafting, and prosecution.
Guide and conduct patent FTO studies. Support product design-around
efforts.
Conduct patent invalidity studies. Strategize competitor patent
invalidation and licensing efforts.
Guide international patent prosecution, FTO, and strategy.
Competitor monitoring.
Enforce, leverage, and monetize Getinge's patent portfolio.
Provide IP trainings.
Explain complex IP topics to non-legal employees.
Support M&A due diligence and post-acquisition integration.
Who You Are
To be successful in this role, we believe you should have the
following background:
Science or engineering degree is required.
Law degree is required.
USPTO registration, and attorney bar admission in at least one US
state, is required.
At least 8 years of patent or IP practice is required. In-house
experience is preferred.
Experience in the MedTech sector and/or with medical device patents
is preferred.
Patent prosecution experience is strongly preferred. Experience
reviewing invention disclosures and evaluating patentability is
preferred. Experience with internal IP "mining" and "harvesting" is
appreciated.
Patent FTO experience is preferred.
M&A IP due diligence experience is highly appreciated.
Licensing, commercial contract, IPR, and IP litigation experience
are all appreciated.
Experience managing and evaluating patents outside the US (EPO, JP,
CN) is preferred. Past exposure to EPO patent practice is
particularly valuable.
Excellent written and verbal communication, are required. Knowledge
of additional languages (such as German, Swedish, French, Mandarin,
or Danish) is plus.
